Registering a trademark in Kosovo: why a local filing with KIPA is essential

· Guide · 5 min read · From Administrator

Kosovo has its own trademark register and stays outside the Madrid System. What this means for your business and how to protect your mark with the Kosovo Industrial Property Agency (KIPA).

For many Albanian businesses, Kosovo is the natural second market – and vice versa. But where trademarks are concerned, Albania and Kosovo are two separate jurisdictions, with different registers, offices and laws. A trademark registered in one country is not automatically protected in the other.

The legal framework in Kosovo

In Kosovo, trademarks are governed by the Law on Trademarks (No. 04/L-026, as amended), which is broadly harmonised with EU standards. Registration and protection are administered by the Industrial Property Agency (KIPA), under the competent ministry. The law sets out the conditions for registration, the owner's rights, the opposition procedures and enforcement. You will find the summary in the legal library.

The principles are familiar to anyone who has applied in Albania: the mark must be distinctive; signs that lack distinctiveness or are descriptive, deceptive or contrary to public policy are refused (absolute grounds), while conflicts with earlier marks are raised through opposition (relative grounds). The owner gains the exclusive right to use the mark and to prevent others from using identical or similar signs for identical or similar goods – but only within Kosovo.

Why registration in Albania is not enough

Trademark protection is territorial: it applies only where the mark is registered. If your mark is registered with DPPI and you start selling in Kosovo, you have no protection there until you also register it with KIPA. Meanwhile, another party may register the same sign in Kosovo before you. This is why conflicts between Albanian and Kosovo trademarks are frequent, and why checking both registers before filing is essential.

Kosovo outside the Madrid System

This is the most important practical difference. Kosovo is not a member of the World Intellectual Property Organization (WIPO) and is not a party to the main international industrial property agreements: the Madrid System for trademarks, the Hague Agreement for designs and the PCT for patents.

As a result, an international registration through Madrid – even when it covers dozens of countries – does not extend protection to Kosovo. The only route is a national application filed directly with KIPA. Even a world-famous trademark can remain “free” in Kosovo until someone registers it there first. You will find the full explanation in Kosovo outside the international systems.

The lesson: for the Kosovo market, always file a local application with KIPA – do not rely on international protection.

How the procedure works

The steps are similar to those in Albania:

  1. Filing the application with KIPA, with the sign, the owner and the goods and services according to the Nice classes. Applications in Kosovo have numbers in the form KS/M/year/number.
  2. Examination: KIPA examines whether the sign can be protected, in particular whether it is distinctive.
  3. Publication in KIPA's bulletin.
  4. Opposition: holders of earlier rights can oppose within the legal deadline after publication – which is why it is worth following the bulletin.
  5. Registration and protection for 10 years, renewable for 10-year periods without limit.

The power of attorney for Kosovo is simpler

For applications in Kosovo, a scanned, signed power of attorney is enough: you upload it on the power of attorney page on trademark.al and no post is needed. As an individual, you sign the power of attorney before a notary. The deadline for sending it is 30 days, as for every application.

After registration: use it and protect it

  • Genuine use: in Kosovo too, a mark can be revoked if it is not genuinely used for 5 years without a justified reason.
  • Enforcement: the owner can ask the courts of Kosovo to stop the infringement and award damages, and can request the cooperation of customs to stop counterfeit goods at the border.
  • Monitoring: on trademark.al, monitoring also compares your mark with the trademarks of Kosovo and with ARBK businesses.

How to apply for Kosovo on trademark.al

In the first step of the form, choose Kosovo as the territory. If you have your own representative for Kosovo, they are shown locked; otherwise choose a public representative, or the application is taken by the representative TMA assigns for Kosovo. The payment page shows the state office fee, legal representation, the administration fee and the transaction fee – the same total by card or by bank transfer.

Before applying, check the name in the public search: it shows the trademarks of Kosovo and Albania at once, as well as ARBK and QKB businesses.

Strategy for businesses operating in both countries

  • Apply in both countries, ideally at the same time, with the same sign and the same class logic.
  • If you apply in one country first, do not delay the application in the other: until then, someone else may get there before you.
  • Bear in mind that each registration is followed and renewed separately.

Frequently asked questions about Kosovo

Can I have the same representative for Albania and for Kosovo?

Yes, if the representative is authorised for both countries. On trademark.al you have your own representative for each country; it can be the same person for both, or two different representatives. The appointment takes effect only when the representative accepts your request. You will find the steps in My representative.

Do Kosovo trademarks appear in the search?

Yes. The public search includes Kosovo trademarks and ARBK businesses, alongside Albanian trademarks and QKB businesses. The name check in the form also checks the trademarks and companies of the country you choose.

How do I follow the status of an application in Kosovo?

Just as for Albania: on the mark's page you see the application status and the official status, and you get a notification every time the representative files the mark or changes the status.

Does the same classification of classes apply?

Yes. KIPA also uses the Nice Classification with 45 classes, so you can use the same list of goods and services in both applications.
